Why the consent conversation has changed in 2026

Three things happened in the last twelve months that quietly changed the math for anyone running paid lead programs, online orders, or subscription enrollments.

First, the regulatory layer thickened. The FCC confirmed that AI generated voices count as artificial voices under the TCPA, so any AI call to a consumer now needs the same prior express written consent a human dialed call has needed since the lead generator loophole closed in 2023. State mini TCPA laws (Florida FTSA, Washington WADAD, Oklahoma, Maryland, Tennessee) keep stacking. Maryland HB0107 took effect June 1, 2026 as the latest state to join the click to cancel mosaic. NYC has a proposed municipal rule with civil penalties starting at $525 per violation.

Second, the card networks tightened. Visa lowered the VAMP “excessive” chargeback threshold to 1.5% in April 2026. Mastercard’s Scam Merchant Monitoring Program reaches full effect on July 24, 2026, three days before ASE opens. Visa Compelling Evidence 3.0 introduced a per qualification fee in April, with another expansion landing October 24, 2026.

Third, the litigation layer got louder. Kaiser Permanente settled a session replay class action for $46 million in May 2026. AI cold calling lawsuits like the Mortgage One putative class are working through early motion practice. Realogy settled a TCPA matter for $20 million.

Every one of those changes converges on the same defense: the rendered page as the specific consumer actually saw it, the affirmative click, the timestamp, and the device. When that record exists, the defense is short. When it does not, the loss is the entire dispute.
